These Terms & Conditions ("Terms") govern your use of the EstimateVision AI estimating application and related websites (the "Service") provided by EstimateVision ("EstimateVision", "we", "us", or "our"). By using the Service, you are contracting with EstimateVision.

1. Acceptance

By creating an account or continuing to use the Service, you agree to these Terms. If you are using the Service on behalf of a business, you confirm you have authority to bind that business. If you are using it as an individual, you confirm you are of legal age to enter into this agreement.

2. The Service

EstimateVision is an AI-powered tool that turns job-site photos, video, and voice input into construction estimates and proposals priced for your area. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you select.

3. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose, fraud, or spam;
• infringe the intellectual property or other rights of any party;
• interfere with or compromise security, including introducing malware, probing, or scraping;
• reverse engineer, resell, or redistribute the Service or circumvent its limits;
• generate illegal content, deepfakes, hateful content, or attempt to jailbreak the AI.

4. AI outputs and your responsibilities

The Service uses generative AI. You are responsible for your inputs (including having the rights to any photos, video, and content you upload), for how you use the outputs, and for verifying their accuracy before relying on them. AI-generated estimates and scopes may be inaccurate or incomplete and are not a substitute for your professional judgment. You should review and adjust every estimate before sending it to a customer or relying on it for a bid. As between you and us, you retain rights to your input content, and you may use the estimates and proposals you generate for your business.

If you believe content processed through the Service infringes your rights, contact us and we will review and act on valid complaints, including removing content and taking action against repeat infringers.

5. Intellectual property

We retain ownership of the Service and all related intellectual property, including the software, documentation, and branding. You grant us a limited license to host and process your content solely to provide the Service.

6. Payment and subscription terms

EstimateVision is the seller and merchant of record for all orders. Payments are processed securely by our payment processor, Stripe, and your use of checkout is also subject to Stripe's terms. Prices are shown at checkout and applicable taxes may be added. Subscriptions renew automatically for the selected billing period until cancelled, and you can cancel at any time from the billing section of your account or through the customer billing portal. Refunds are governed by our Refund Policy.

7. Service level

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury where the law prohibits such a limitation.

9. Suspension and termination

We may suspend or terminate your access to the Service for:

• material breach of these Terms;
• non-payment;
• security or fraud risk; or
• repeated or serious policy violations.

On termination, your right to use the Service ends. You may request an export of your data within a reasonable window before it is deleted.

10. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date above. Continued use of the Service means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which EstimateVision is established, and disputes will be handled by the courts of that jurisdiction, except where applicable law requires otherwise.
